Agreement to Terms
By accessing or using My Bitcoin DCA ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1. Service Description
1.1 What We Provide
My Bitcoin DCA is a notification and tracking service that:
- Sends scheduled notifications for Dollar Cost Averaging (DCA) Bitcoin purchases
- Monitors Bitcoin network fees for optimal withdrawal timing
- Tracks your purchase and withdrawal history
- Provides analytics and insights on your DCA strategy
- Monitors blockchain confirmations for your transactions
1.2 What We Don't Provide
- Custody Services: We never hold your Bitcoin or fiat currency
- Trading Execution: All trades are executed by you directly on your exchange (Binance or Kraken)
- Withdrawal Execution: All withdrawals are executed by you from your mobile device
- Financial Advice: We do not provide investment, tax, or legal advice
- Guaranteed Results: Past performance does not guarantee future results
2. Eligibility
2.1 Age Requirement
You must be at least 18 years old to use this Service.
2.2 Legal Compliance
You represent and warrant that:
- You are legally permitted to use cryptocurrency services in your jurisdiction
- You comply with all applicable laws regarding cryptocurrency
- You have a valid exchange account (Binance or Kraken) in good standing
- You will not use the Service for illegal purposes
2.3 Prohibited Jurisdictions
The Service may not be available in all countries. You are responsible for ensuring that your use of the Service complies with local laws and regulations.
3. Account Responsibilities
3.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- Securing your mobile device and passcode
- Protecting your exchange API keys stored on your device
- Using a static IP address with exchange API whitelist
- All activities that occur under your account
3.2 API Key Security
- Enable static IP whitelisting on your exchange API keys
- Grant minimum necessary permissions (no withdrawals to untrusted addresses)
- Enable withdrawal address whitelisting on your exchange
- Never share your API keys with anyone
- Rotate API keys regularly
3.3 Device Security
Since your API keys are stored on your mobile device, you must:
- Keep your device's operating system updated
- Use device encryption and passcode protection
- Avoid jailbroken or rooted devices
- Report lost or stolen devices immediately
- Enable biometric authentication when available
4. User Obligations
4.1 Prohibited Activities
You agree NOT to:
- Use the Service for money laundering or illegal activities
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble the Service
- Use automated scripts or bots to abuse the Service
- Violate rate limits or attempt to bypass security measures
- Share your account credentials with others
- Use the Service in a way that could damage, disable, or impair it
4.2 Compliance
You are solely responsible for complying with all applicable tax laws and regulations in your jurisdiction. We do not provide tax reporting or advice.
5. Referral Programme
5.1 How Referrals Work
My Bitcoin DCA offers a referral programme that allows users to earn commissions by referring new paying subscribers. By participating, you agree to the following terms:
5.2 Referral Tracking Requirements
- The referred user must sign up using your unique referral link
- Registration must occur on the web platform (not the mobile app)
- The referral link must be used at the time of registration
If a user clicks your link but later registers through the mobile app or directly on the website without the referral link, the referral will not be tracked and no commission will be paid.
5.3 Commission Eligibility
You earn commissions when:
- A referred user successfully registers using your referral link
- The referred user subscribes to a paid plan
- Payment is successfully processed
Commission rates and minimum payout thresholds are displayed in your referral dashboard and may be changed at our discretion with notice.
5.4 Prohibited Activities
The following activities are prohibited and may result in forfeiture of commissions and account termination:
- Self-referrals or referring your own alternate accounts
- Creating fake accounts to generate referral commissions
- Spamming or unsolicited bulk messaging with referral links
- Misrepresenting the service to potential referrals
- Using paid advertising that violates platform policies
- Any fraudulent or deceptive practices
5.5 Programme Modifications
We reserve the right to modify, suspend, or terminate the referral programme at any time. We may also withhold or reverse commissions if we suspect fraudulent activity or violation of these terms.
6. Subscription and Billing
6.1 Payment Processing
All payments are processed securely by Stripe, a PCI-DSS compliant payment processor. By subscribing to our Service, you agree to Stripe's Terms of Service and Privacy Policy.
- We do not store your full credit card details on our servers
- Stripe handles all payment card processing and security
- We store only your Stripe customer ID and subscription status
6.2 Subscription Plans
My Bitcoin DCA offers monthly subscription plans. Current pricing is displayed on our website and may be updated from time to time with notice to existing subscribers.
- Subscriptions are billed monthly in advance
- Your subscription automatically renews each billing period
6.3 Free Trial
We may offer free trial periods for new subscribers. At the end of the trial:
- Your subscription will automatically convert to a paid plan
- You will be charged the applicable subscription fee
- You may cancel before the trial ends to avoid charges
6.4 Cancellation
You may cancel your subscription at any time through your account settings or by contacting support.
- Cancellation takes effect at the end of your current billing period
- You retain access to paid features until the period ends
- No partial refunds are provided for unused time in a billing period
6.5 Refund Policy
- Technical issues preventing service access that we cannot resolve
- Billing errors or duplicate charges

6.6 Price Changes
We reserve the right to modify subscription prices. For existing subscribers, we will provide at least 30 days' notice before any price increase takes effect. You may cancel your subscription before the new pricing applies.
7. Disclaimers and Risks
7.1 Financial Risks
- Cryptocurrency prices are highly volatile
- You may lose some or all of your investment
- Past performance does not guarantee future results
- DCA does not eliminate risk, only spreads it over time
- Network fees can significantly impact small transactions
7.2 Service Availability
The Service is provided "AS IS" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- Notification delivery (depends on third-party services)
- Accuracy of price data or fee estimates
- Availability of exchange APIs (Binance, Kraken) or mempool.space
- Protection against all security vulnerabilities
7.3 Third-Party Services
The Service integrates with exchanges (Binance, Kraken), mempool.space, and other third-party services. We are not responsible for:
- Exchange downtime, API changes, or account issues
- Blockchain network congestion or delays
- Third-party data accuracy or availability
- Changes to third-party terms of service
7.4 Not Financial Advice
The Service does not provide investment, financial, tax, or legal advice. All decisions regarding purchases, withdrawals, and timing are made solely by you. Consult with qualified professionals before making financial decisions.
8. Limitation of Liability
To the maximum extent permitted by law:

- Loss of cryptocurrency or fiat funds
- Missed purchase or withdrawal opportunities
- Incorrect fee estimates or price data
- Failed or delayed notifications
- Exchange API errors or account restrictions
- Device theft, loss, or compromise
- User error in executing trades or withdrawals
- Tax consequences of your transactions
- Market losses or missed gains
8.2 Damages Cap
Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months prior to the claim.
8.3 Exclusions
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
9. Indemnification
You agree to indemnify and hold harmless My Bitcoin DCA, its operators, and affiliates from any claims, damages, or expenses arising from:

- Your cryptocurrency trading or withdrawal activities
- Compromise of your API keys or device

10. Termination
10.1 Your Right to Terminate
You may terminate your account at any time through the settings page or by contacting support. Upon termination:
- Your account will be deactivated
- Your data will be deleted per our Privacy Policy
- You should delete API keys from your mobile device
- Transaction history may be retained for legal compliance
10.2 Our Right to Terminate
We may suspend or terminate your account if:
- You violate these Terms
- You engage in illegal or fraudulent activity
- Your account is inactive for an extended period
- Required by law or regulatory authority
- We discontinue the Service

12. Modifications to Terms

- Requiring acceptance for substantial changes
Continued use of the Service after changes constitutes acceptance of the modified Terms.
